Canadian marketing, digital marketing and specifically anti-spam legislation is different than U.S. law: • Canadian SPAM is different. The Canadian regime has an active opt-in provision for email lists, and so unsolicited emails of a commercial nature can result in material fines. • Canadian advertising law falls under the Canadian Code of Advertising Standards and the Competition Act, which prohibit fraudulent or misleading advertising. • The Canadian Radio-television and Telecommunications Commission (CRTC) oversees other forms of advertising, including telemarketing. If you are going to conduct affiliate sales by phone in Canada, you will have to comply with the CRTC’s rules, including putting yourself on Canada’s National Do Not Call List. • Consumer Protection laws federally and provincially will apply to your activities too; be aware of your requirements under these laws. There has never been a regulated role for affiliates in Canada’s gaming market. The expected changes will be a sea of change for affiliates interested in working within our market.
